LEGAL GUIDELINES ON FENCES AND ELEMENTS THERE IN IT
Fencing as an infrastructure element is governed by the law according to OJ 2015.0.1422 i.e. - Regulation of the Minister of Infrastructure of 12 April 2002 on the technical conditions to be met by buildings and their location. These provisions are contained in Chapter 9 of this document.
These provisions apply both to the fence itself and to the elements present in it, i.e. gates and gates.
§ 41. Rules on fencing
1. The fence shall not endanger the safety of humans and animals.
2. The placing on fences, at a height of less than 1,8 m, of sharply terminated elements, barbed wire, broken glass and other similar products and materials shall be prohibited.
3. The provisions of paragraphs 1 and 2 shall not apply to internal fences in prisons and detention centres.
§ 42. Gates and gates
1. Gates and gates in the fence must not open outside the plot.
2. Gates in the fence at multi-family dwellings and public buildings must not impede access to them by persons with disabilities in wheelchairs.
§ 43. Gate dimensions
The width of the gate shall be at least 2,4 m in the light and, where the gate is used, its width shall be not less than 0,9 m, these widths being governed by separate fire protection provisions.
