WHO WILL PAY FOR THE FENCE BETWEEN THE PLOTS?

Article 154. § 1. It is presumed that walls, fences, honeys, ditches and other similar devices, located on the border of neighbouring land, are used by neighbours for common use. The same applies to trees and shrubs on the border.
§ 2. The users of these devices shall jointly bear the cost of maintaining them.

This means that the neighbours jointly bear the costs associated with the maintenance of the fence.
What if there is already a fence that is old and does not match the appearance of our property (disfigure). Unfortunately, in this case, we can not charge our neighbor for the cost of building a new fence if he is not interested in a new fence.
